Photovoltaic legislation

Also for the photovoltaic sector, the current legislation involves responsibilities on the part of Producers as regards the management of end-of-life photovoltaic modules.

Legislative Decree 49/2014, which transposed the WEEE Directive 2012/19/EU, provides that photovoltaic panels should be considered ‘electrical and electronic equipment’ (EEE) and, as such, at the end of their life they must be recovered and handled as WEEE.

With the entry into force of the Environmental Provisions (Article 41 of Law No. 221 of 28 December 2015), so as to ensure the  proper end-of-life management of photovoltaic panels, for both domestic or professional use, it has been provided that for modules placed on the market as from February 2016, the Producers, through the compliance schemes to which they belong, provide for a financial guarantee and geo-positioning system.
