Producers of Electrical and Electronic Equipment (EEE), as well as of Batteries and Accumulators, must comply with the duties laid on them in legislative decree151/2005 concerning WEEE and of decree 188/08 on batteries and accumulators.
Under the terms of Legislative Decree 151/2005 "producers" means
anyone that, regardless of the sales arrangements used:
• makes and sells Electrical
and Electronic Equipment bearing their own trade mark;
• resells equipment that is produced by other suppliers and badged
with its own trade mark;
• is the first to import or release onto the Italian market
electrical and electronic equipment as part of a business and
handles their commercialisation.
Under the terms of Legislative Decree 188/08 "producers" means
anyone that, regardless of the sales arrangements used, releases
onto the market for the first time in a business capacity batteries
and accumulators, including those that are inside equipment or
vehicles.
Legislative Decrees 151/2005 and 188/2008 make it a duty on
producers of EEE and of batteries and accumulators to fund the
transport operations and also those for treating, recovering, and
ensuring the eco-compatible disposal of WEEE, batteries, and
accumulators.
The producers have a collective responsibility, each in proportion
to their respective market shares.
